Mediation
You are an heir in an estate and you fail to reach agreements by mutual agreement, which means that a conflict is imminent or will escalate. You may choose to approach a mediator. The mediator will try to achieve a solution between all stakeholders. LYS Advocaten employs professional mediators to guide you in discussing an acceptable solution for everyone at the table. Settling an estate
An estate is the property left behind by the deceased that must be divided among the heirs under inheritance law. If the deceased did not create a last will and testament, the law regulates who is an heir and how the estate should be divided. If the deceased made a last will and testament, this document states who were appointed heirs and any other dispositions will be included in it.
Once it is known who the heirs are, it is necessary to discuss how they want to accept the estate. Do they want to accept unconditionally, under the benefit of inventory, or reject? What is the most sensible option? In case of an estate accepted under the benefit of inventory, settlement is the next step, and it is mandatory. Ultimately, assets must always be distributed correctly.
